- Apple has been asked to pay $184 million in additional to the current $634 settlement to Masimo over patent infringement.
- Apple sold 43 million units of Apple Watch back in 2023 with the technology patented by Masimo using power-efficient method for its pulse oximeter.
- This makes Masimo a victor with $818 million in total settlement from Apple.
Apple has been ordered to pay an additional sum of $184 million in interest on its previous $634 million verdict in the Apple vs. Masimo patent infringement case. This lands the Cupertino-based giant in a hole, with a total of $818 million in infringement damages that it has to pay to Masimo.
Apple to pay an additional $184 million for patent infringement on Apple Watch (2023)
Last year, Masimo filed a case against Apple over the use of low-power pulse oximeter and blood oxygen features on its Apple Watch sold in 2023. Masimo played on the fact that the Apple Watch falls into the category of ‘patient monitoring,’ which is a continuous monitoring device.
Although Apple tried to defend the feature, mentioning it swings into action only when the wearer is motionless for 10 minutes, the jury found out about Apple’s lies and instead handed it over a settlement of $636 million to Masimo.
For a year, Masimo has been trying to corner Apple by filing more than 25 patent infringement cases. Talking about the latest one, Apple has been asked to pay a sum of $184 million in interest to Masimo, as opposed to the $243 million ask. This is for the 43 million Apple Watch units that Apple had sold with the questionable patent (no. 10,433,776).
Paying a total of $818 million is nothing for Apple, which is currently valued at $4.8 trillion and counting. On the other hand, it is a fortune for Masimo, which was recently sold to Danaher Corporation for an all-cash acquisition of $9.9 billion.
